Flipkart to pay Rs 1 lakh penalty in pressure cooker case as per Delhi HC's order

The Delhi High Court upheld the Central Consumer Protection Authority's (CCPA) directive to impose a fine of Rs. 1 lakh on the e-commerce platform in its decision in the Flipkart v. CCPA case on Friday.

Flipkar

The court ordered the Walmart-owned business to notify its customers that the cookers listed on Flipkart do not meet Bureau of Indian Standards and to submit the fine amount as soon as possible with the Registrar of Courts (BIS).

In August, the CCPA issued a ruling on Flipkart's infringement of consumer rights for allowing the sale of domestic pressure cookers in defiance of legal requirements.

Flipkart was also required by the CCPA to inform customers about all 598 pressure cookers sold on its site, recall the cookers, pay customers for their purchase costs, and submit a compliance report regarding the same within 45 days. Additionally, the firm was ordered to pay a Rs. 1,000,000 fine for violating the rights of customers by allowing the sale of such pressure cookers on its e-commerce site.

However, the Delhi High Court bench deferred the recall of pressure cookers and the compensation of purchasers' pressure cooker purchases.

The panel further instructed CCPA to provide a response to the plea filed by Flipkart. The hearing date has been set for November 14.

The CCPA has started a nationwide campaign to stop the sale of fake and counterfeit goods that breach QCOs set by the Central Government in order to increase consumer knowledge and quality consciousness. Helmets, domestic pressure cookers, and cooking gas cylinders are among the everyday items included in the campaign. In order to examine unfair business practises and violations of consumers' rights related to the production or sale of such products, the CCPA has written to District Collectors around the nation and requested that they submit an Action Taken Report.
